The High Court is the highest judicial Court in every State/ Union territory in India. Articles 214 to 237 of the Constitution of India lay down provisions applicable to High Courts in India. Delhi High Court, specifically, was established in the year 1966. It has been provided with original civil and criminal jurisdiction apart from the power to review/ change the decision taken by a Court subordinate to it. Only a few lawyers experienced in the field of law have a hold over matters pertaining especially to the jurisdiction of the Delhi High Court. If you are looking for somebody who can not only guide you in an issue under the ambit of the Delhi High Court but can also represent you aggressively before the esteemed Bench, connect with Karan S. Thukral, a Delhi High Court Advocate in India.

Jurisdiction of High Courts in India

All High Courts in India have original, writ, appellate and supervisory jurisdiction.

  1. Original Jurisdiction: In many cases, the High Court has been provided with a power to hear the issue in the first instance and not as an appeal. Such matters generally pertain to infringement of fundamental rights. Other matters include admiralty, will, marriage, divorce, company laws and contempt of court.

  1. Writ Jurisdiction: The Constitution of India under Article 226 provides power to the High Court to hear Writ Petitions in order to effectuate fundamental rights. The Supreme Court too has been provided with a similar power under Article 32 of the Constitution. However, the powers given to the High Court are wider in scope inasmuch as it can hear writs for other matters as well.

  1. Appellate Jurisdiction: As the words clearly suggest, the Delhi High Court has power to hear appeals against decisions/ orders pronounced by subordinate Courts in both Civil as well as Criminal matters.

  1. Supervisory Jurisdiction: The power of Superintendence has been provided to the High Courts. By this power, the High Court exercises supervision over all subordinate courts within its territory other than Military Courts and Tribunals.

Powers Entrusted to a High Court

The High Courts have been entrusted with various powers including that of making rules subject to the constitutional framework. The Bombay High Court in the case of ‘Salubai Ramchandra vs Chandu Sadhu’ has held that ‘The power of the High Court to make rules is subject to the provisions of the Constitution’. For an Advocate practicing law in a High Court, it is necessary that he understands such rules and tries to read those with the laws laid down by the legislature.

Duties of a High Court Lawyer

  1. Uphold Interest of the Client

It is the duty of every lawyer to uphold the interest of the client and work towards success.

  1. Not suppress material or evidence

Suppressing facts or evidence is a huge negligence on the part of the lawyer and it should be avoided at all costs. A High Court advocate is expected to provide complete information to the Client and present the facts as they are.

  1. Maintain confidentiality

While handling a case or taking a brief, it is the duty of the lawyer to maintain confidentiality and not disclose the information to any third person without the authority of the client.

  1. Should not act on the instructions of any person other than his client or the client’s authorized agent
  1. Transparency and complete disclosure to client

Transparency plays a key role when it comes to handling a case. For a lawyer practicing in High Court, it is mandatory to keep the process transparent and uphold the interest of the client.
