Almost every client who walks into a divorce lawyer's office has the same thing in their pocket: a phone full of messages, a few voice notes, and sometimes a call they recorded at 2 a.m. because they knew nobody would believe what was said.

The question that follows is always the same. Will the court accept this as evidence in a divorce case? Often, yes. But how you collect it, store it and present it decides whether a judge treats it as proof or ignores it. This guide explains how WhatsApp chats as evidence in India and call recording as evidence in divorce work in Delhi's Family Courts. If you want your material reviewed, talk to a divorce lawyer in Delhi before you file anything.

The Short Version

  • §
WhatsApp chats can be used in a divorce case, but a screenshot on its own is a weak way to prove them.
  • §
Call recordings between spouses can be used too. The Supreme Court settled this in Vibhor Garg v. Neha (2025).
  • §
Authentication — both need it, which usually means a certificate under Section 63 of the Bharatiya Sakshya Adhiniyam (BSA).
  • §
Admitted vs believed — being admitted by the court is one thing. Being believed is another.

Are WhatsApp Chats Valid Evidence in a Divorce Case?

A WhatsApp message is an electronic record. Electronic records are proved under Section 63 of the Bharatiya Sakshya Adhiniyam, which replaced Section 65B of the Evidence Act. If you rely on a printout, a screenshot or a copy, you generally need a certificate confirming it came from the device and wasn't edited.

This is where most people trip. They print screenshots and assume that's enough. Then the other side says, "I never wrote that," or "that chat has been edited," and without the certificate and the original device you are left arguing.

The Supreme Court has said more than once that this certificate is not a formality. In Anvar P.V. v. P.K. Basheer (2014) and Arjun Panditrao Khotkar (2020), it stressed that electronic evidence needs certification unless the original device itself is produced. Don't count on fixing it later.

What Makes a Chat Stronger

📱 The original phone, or the device the chat was exported from, is available and unaltered.
💬 The full conversation is saved, not a few handpicked messages.
🕒 Numbers, dates and timestamps are clearly visible.
📜 A proper Section 63 certificate accompanies the printouts.
🔗 You can link the number to your spouse (a saved contact, old bills, or other messages confirming ownership).

Is Call Recording Admissible in a Divorce Case in India?

For years High Courts disagreed. One view said secretly recording your spouse breaches privacy, so the recording can't be used. Another said that if it's relevant, the court should look at it.

In Vibhor Garg v. Neha (2025), decided on 14 July 2025, the Supreme Court cleared this up. It held that a recorded phone conversation between spouses can be admitted in a divorce case, even if the other spouse didn't know. The old Section 122 of the Evidence Act, which protects private communication between spouses, doesn't block this in a dispute between the spouses themselves.

But the Court didn't hand over a free pass. A recording still has to pass three checks:

🎯

1. Relevance

Does it relate to the issue in the case?

🗣️

2. Identification

Can the voices be clearly identified?

🎙️

3. Accuracy

Is the recording complete, untampered and audible?

The electronic evidence certificate applies here too. A recording on a memory card, pen drive or phone must be authenticated the same way a chat is.

Does it matter that your spouse didn't know? In a case between the two of you, secret recording of a call you were part of is no longer an automatic bar. Courts care more about whether it is genuine and relevant.

There is still a line. Recording your own conversation is very different from hacking your spouse's phone, reading their private accounts, installing spy software, or recording their conversation with someone else. Those can bring separate legal trouble under the Information Technology Act and other laws. If you're unsure how something was obtained, tell your lawyer before you file it.

Family court flexibility. Section 14 of the Family Courts Act lets a family court accept material that helps it decide the matter, even if strict evidence rules wouldn't allow it. That is why chats and recordings are often taken on record early. But it governs what gets in, not what the court believes. Build your evidence as if every rule applies, because the other side will argue that it does.

Section 63 BSA Certificate: What It Is and Who Signs It

The certificate has two parts, set out in the Schedule to the BSA:

✍️

Part A

Signed by the person who produces the electronic record, usually the owner or person in charge of the device. It describes the device and confirms the record is a true copy.

🔬

Part B

Signed by an expert. It records technical details, including the hash value of the file, which shows the file hasn't changed since it was copied.

Get the certificate prepared when you collect the evidence, not months later. Your advocate can confirm the current format before filing.

Which Evidence Helps for Which Ground

Ground How Chats and Recordings Help
Cruelty Abusive messages, threats, humiliating voice notes and repeated harassment can support mental cruelty. One angry text rarely does. A pattern over time carries weight.
Adultery Direct proof is hard to find, and courts know it. A divorce case is decided on probabilities, not beyond reasonable doubt, so chats, hotel bills and travel records pointing firmly in one direction can be enough.
Desertion Messages showing a spouse left without reason, refused to return or cut off contact help establish the timeline.
Maintenance & Custody Chats about income, hidden assets, parenting, or behaviour around the child can matter as much as the divorce ground.

For disputes that usually arise alongside these, see common divorce case problems in Delhi.

Delhi note: matrimonial cases in Delhi are heard in the Family Courts at Tis Hazari, Dwarka, Saket, Rohini, Karkardooma and Patiala House, depending on where the parties live or were married. Your lawyer will confirm the right court and how that court handles electronic evidence.

How to Preserve Digital Evidence

01
Keep the Original Device

Don't sell, reset or repair it without a backup.

02
Export, Don't Just Screenshot

Use WhatsApp's "Export chat" with media. Take screenshots too, but as a supplement.

03
Turn Off Disappearing Messages

Switch them off and save what remains.

04
Don't Trim or Edit

Store recordings untouched and make a separate typed transcript.

05
Write Down the Context

Note the date, time, language and who was on the call.

06
Make Multiple Backups

Keep copies on a pen drive, in the cloud and on a laptop.

Mistakes That Damage Good Evidence

  • ✗
Sharing only the favourable messages — the other side will produce the rest.
  • ✗
Forwarding chats to relatives and friends — it muddies the trail and may end up on social media.
  • ✗
Sending angry messages yourself — your messages are evidence too.
  • ✗
Deleting chats out of embarrassment — deleting after a dispute starts can look like destroying evidence.
  • ✗
Accessing the other person's phone or accounts — the method can become a separate case against you.

Admissible doesn't mean you win. Judges notice context, tone and who started the argument. Evidence works best as part of a clear story built with pleadings, witnesses and documents. After Vibhor Garg v. Neha, a recording of your own conversation with your spouse can be used in a matrimonial case if it is relevant, identifiable and accurate. Secretly accessing their phone or recording their talks with other people is a different matter, and risky.
Family courts can hold proceedings in camera under Section 11 of the Family Courts Act, so the hearing is not open to the public. Still, be careful about what you choose to file.
Yes, and they often do. The court may compare voices, look at the original file or call for forensic examination, which is why keeping the original untouched matters so much.
Generally yes for printouts, copies and recordings, unless the original device itself is produced in court. Your advocate can tell you what your case needs.
